By accessing or using the Website or any Service, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy, the Terms & Conditions, and the Disclaimer in full. If you do not agree, you must discontinue use of the Website and Services immediately.

9. Affiliate Marketing Disclosure

Techforest operates and/or participates in affiliate marketing arrangements. Certain links, banners, or references on the Website may be affiliate links, and Techforest may earn a commission on qualifying actions or purchases made through such links, at no additional cost to you. 13. Children's Privacy

The Website and Services are not directed to individuals under the age of 18. Techforest does not knowingly collect personal information from children. If we become aware that we have inadvertently collected information from a minor without appropriate consent, we will take steps to delete it promptly.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Techforest, its directors, officers, employees, and agents shall bear NO LIABILITY whatsoever for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with: (a) your use of, or inability to use, the Website; (b) unauthorized access to or alteration of your data; (c) any third-party conduct, content, or service accessed through the Website; or (d) any other matter relating to the Website or Services. This limitation applies regardless of the legal theory asserted and even if Techforest has been advised of the possibility of such damages. The Website and all information provided are made available on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied.

21. Indemnification

You agree to indemnify, defend, and hold harmless Techforest and its directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your breach of this Privacy Policy, the Terms & Conditions, the Disclaimer, or your misuse of the Website or Services.

22. Modification of Privacy Policy

Techforest reserves the right to modify, amend, or update this Privacy Policy at any time, at its sole discretion. Changes take effect immediately upon publication on this page. 23. Termination of Access

Techforest reserves the right, at its sole discretion and without prior notice, to suspend or terminate your access to the Website or Services for any reason, including suspected violation of this Policy or the Terms & Conditions, without any liability to you.

24. Governing Law & Jurisdiction (India)

This Privacy Policy shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. Subject to Part II, Section 27 (Arbitration & Dispute Resolution), the courts of the jurisdiction where Techforest is registered/operates shall have exclusive jurisdiction over any disputes.

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Client”, “you”) and Techforest governing your access to and use of the Website and Services. By accessing the Website, registering an account, or engaging any Service, you agree to be bound by these Terms in full. If you do not agree, you must not use the Website or Services.

2. Definitions
  • “Website” means https://techforest.govevents.in and any associated subdomains or platforms.
  • “Services” means all offerings described in Section 7 of these Terms.
  • “Content” means text, graphics, code, designs, videos, and other materials made available on the Website.
  • “User Content” means any material a User submits, uploads, or provides to Techforest.
  • “Fees” means amounts payable for Services as agreed in a quotation, invoice, or order confirmation.
3. User Eligibility

By using the Website or Services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872. If you use the Services on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms.

4. User Registration & Account

Certain Services may require registration of an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. Techforest reserves the right to refuse, suspend, or terminate any account at its sole discretion.

5. Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify Techforest immediately of any unauthorized use. Techforest bears no liability for any loss or damage arising from your failure to safeguard your account credentials.

6. Acceptable Use Policy

You agree not to: (a) use the Website or Services for any unlawful purpose; (b) infringe the intellectual property or other rights of any party; (c) upload malicious code, viruses, or harmful content; (d) attempt to gain unauthorized access to Techforest’s systems; (e) scrape, reverse-engineer, or misuse Website content; or (f) engage in conduct that disrupts or burdens the Website’s infrastructure. Violation of this Acceptable Use Policy may result in immediate suspension or termination of access, without liability to Techforest.

7. Services

Techforest provides the following categories of Services, each governed by these Terms and any service-specific quotation, statement of work, or order form agreed between the parties:

7.1 Website Development Services

Design, development, and deployment of websites based on agreed scope, specifications, and timelines. Hosting, domain, and third-party plugin/license costs are excluded unless expressly stated in the order form.

7.2 Digital Marketing Services

Strategy, execution, and management of digital marketing campaigns across applicable channels. Results, rankings, leads, and conversions depend on numerous external factors and are not guaranteed (see Part III, Earnings Disclaimer).

7.3 SEO Services

On-page, off-page, and technical SEO activities aimed at improving visibility. Search engine algorithms are controlled by third parties; Techforest does not guarantee specific rankings, traffic, or timelines.

7.4 Branding & Graphic Design

Creation of brand identities, logos, and graphic assets based on client briefs and agreed revision rounds. Additional revisions beyond the agreed scope may incur additional fees.

7.5 Social Media Management

Content planning, posting, and community management on client-authorized social media accounts. Platform policy changes, algorithm shifts, or account restrictions imposed by third-party platforms are outside Techforest’s control and liability.

7.6 Video & Content Production

Production of video and written content per agreed creative briefs, with a defined number of revisions. Raw footage and source files remain Techforest property unless otherwise agreed in writing.

7.7 Ecommerce Development

Design, build, and integration of ecommerce platforms, including payment gateway and catalogue integration. Transaction processing, settlement, and gateway compliance are the responsibility of the chosen third-party payment provider.

7.8 Affiliate Marketing Services

Management of affiliate programs and partnerships. Commission structures, eligibility, and payouts are governed by the specific affiliate program terms communicated separately.

7.9 Technical Job Partner Program

A partnership program connecting technically qualified individuals with project or placement opportunities facilitated by Techforest. Participation does not constitute an employment relationship with Techforest, and no guarantee of placement, income, or engagement is made (see Part III, Job Opportunity Disclaimer).

7.10 Digital Learning / Courses (Future-Ready)

Techforest may, from time to time, offer or facilitate digital training and courses. The following sub-clauses apply where such offerings are made available:

7.10.1 Course Enrollment & Participation

Enrollment is confirmed upon full payment of applicable fees (where charged) and acceptance of any course-specific terms. Participants must comply with course conduct guidelines; Techforest may remove participants who violate such guidelines without refund.

7.10.2 Certificates & Examinations

Certificates, where issued, confirm participation and/or completion only, based on criteria set by Techforest. Techforest does not guarantee that any certificate will be recognized by, or equivalent to, any government, academic, or professional accreditation body unless expressly stated.

7.10.3 Awarding & Recognition

Any awards, badges, or recognitions issued by Techforest are internal recognitions of performance or participation and do not constitute a professional license, degree, or statutory qualification.

7.11 Government Event Portal Services (where applicable)

Where Techforest facilitates listing, promotion, or coordination of government-related or public-sector events through a dedicated portal, such services are facilitative only. Techforest is not a government entity, has no government affiliation, and assumes no responsibility for the conduct, decisions, or outcomes of any government department, agency, or third-party organizer (see Part III, No Government Affiliation).

8. Payment & Fees

Fees for Services are as set out in the applicable quotation, invoice, or order confirmation and are payable in advance or per agreed milestones. All Fees are exclusive of applicable taxes (including GST) unless stated otherwise. Late payments may result in suspension of Services without liability to Techforest. Techforest reserves the right to revise its pricing for future engagements at any time.

9. Refund & Cancellation

STRICT NO-REFUND POLICY: All payments made to Techforest for any Service, course, program, or product are FINAL and NON-REFUNDABLE under all circumstances, except where mandatorily required by applicable law.

By making payment, you acknowledge and agree that: (a) Techforest does not provide refunds, partial refunds, credits, or exchanges for any reason, including but not limited to change of mind, dissatisfaction with results, delays attributable to client-side dependencies, force majeure events, or discontinuation of use; (b) cancellation of an ongoing project or course by the client does not entitle the client to a refund of fees already paid for work performed, time allocated, or resources committed; (c) Techforest may, at its sole and absolute discretion, on a case-by-case basis, offer a credit, adjustment, or alternative remedy, but is under no obligation to do so; and (d) this No-Refund Policy applies to all Services listed in Section 7, including Website Development, Digital Marketing, SEO, Branding, Social Media Management, Video/Content Production, Ecommerce Development, Affiliate Marketing, the Technical Job Partner Program, and Digital Learning/Courses.

Where a Service is to be delivered in milestones, Techforest may, at its discretion, cease further work upon non-payment of any milestone, and amounts already paid remain non-refundable.

 

10. Intellectual Property

Subject to full payment of all applicable Fees, ownership of final, agreed deliverables specifically created for a client transfers to the client upon completion, excluding any pre-existing tools, frameworks, code libraries, templates, or methodologies owned by Techforest or third parties, which remain the property of their respective owners and are licensed, not sold, to the client for the agreed purpose. All Website content, trademarks, and proprietary materials not specifically delivered to a client remain the exclusive property of Techforest.

11. User Content

You retain ownership of any content you submit to Techforest (“User Content”) but grant Techforest a non-exclusive, royalty-free license to use, reproduce, and display such User Content solely as necessary to perform the Services, including for portfolio and promotional purposes, unless you expressly opt out in writing. You represent that you have all necessary rights to submit such User Content and that it does not infringe any third-party rights.

12. Confidentiality

Each party agrees to keep confidential any non-public business, technical, or financial information disclosed by the other party in connection with the Services, and to use such information solely for the purpose of the engagement, except where disclosure is required by law.

13. Privacy & Data Protection

Collection and processing of personal information in connection with the Website and Services is governed by Techforest’s Privacy Policy (Part I of this document), which is incorporated into these Terms by reference.

14. Third-Party Services

The Services may involve integration with third-party platforms, tools, hosting providers, payment gateways, or marketing platforms. Techforest is not responsible for the availability, performance, security, or policies of any third-party service, and any issues arising from such third-party services are excluded from Techforest’s liability.

15. Suspension & Termination

Techforest may suspend or terminate access to the Website or any Service, with or without notice, at its sole discretion, including for breach of these Terms, non-payment, suspected fraud, or unlawful conduct. Termination does not entitle the client to any refund of Fees already paid.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHFOREST SHALL HAVE ZERO LIABILITY for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, business opportunity, or goodwill, arising out of or in connection with these Terms, the Website, or any Service, regardless of the legal theory asserted (contract, tort, negligence, strict liability, or otherwise), even if Techforest has been advised of the possibility of such damages. In any event where liability cannot be lawfully excluded, Techforest’s aggregate liability shall not exceed the lesser of (a) the Fees actually paid by the client for the specific Service giving rise to the claim in the three (3) months preceding the claim, or (b) INR 5,000.

17. Indemnification

You agree to indemnify, defend, and hold harmless Techforest, its directors, officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your use or misuse of the Website or Services; (b) your breach of these Terms; (c) your User Content; or (d) your violation of any applicable law or third-party right.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

19. Arbitration & Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms, the Website, or the Services shall first be attempted to be resolved amicably through good-faith negotiation. If unresolved within thirty (30) days, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by Techforest, with the seat and venue of arbitration in India, and proceedings conducted in English. The arbitral award shall be final and binding on both parties.

20. Force Majeure

Techforest shall not be liable for any delay or failure to perform its obligations resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemics, war, civil unrest, government action, internet or power outages, third-party service failures, or labour disputes.

21. Changes to Terms

Techforest reserves the right to modify these Terms at any time, with changes effective immediately upon posting to the Website. Continued use of the Website or Services after such changes constitutes acceptance of the revised Terms.
