This Shipping & Delivery Policy (“Policy”) explains how Techforest (“Techforest”, “Company”, “we”, “our”, “us”) processes, delivers, and hands over deliverables in connection with its digital services, and how any future physical products or merchandise would be shipped, should Techforest choose to offer them. This Policy should be read together with Techforest's Privacy Policy, Website Terms & Conditions, and Disclaimer, which are incorporated herein by reference.

This Policy applies to all Orders placed with Techforest through the Website, email, WhatsApp, in-person discussion, or any other communication channel, and governs the delivery of all Services described in Techforest’s Terms & Conditions, including but not limited to Website Development, Software Development, Mobile Apps, Ecommerce Development, Digital Marketing, SEO, Branding & Graphic Design, Social Media Management, Video & Content Production, Content Marketing, Affiliate Marketing, the Technical Job Partner Program, Digital Learning/Courses & Certifications, and any Government Event Portal facilitation services.
This Policy applies uniformly to all Clients regardless of location, and does not vary based on geography except where mandatorily required by applicable local law.
Techforest is, as of the Effective Date, a predominantly digital-services organization. Its current offerings are intangible in nature, consisting of design, development, strategy, marketing, creative, training, and consulting outputs delivered electronically. References to “shipping” in this Policy are used in the broad sense of “delivery of output” and do not imply courier-based or physical dispatch unless Techforest expressly introduces physical products in the future, as contemplated in Section 5.
All digital Deliverables are provided through one or more of the following methods, as applicable to the Service: (a) email transmission of files or credentials; (b) shared cloud storage links (e.g., Google Drive, Dropbox); (c) direct upload/deployment to client-owned hosting, domains, or platforms; (d) access credentials to a dashboard, portal, or learning management system; or (e) any other electronic method agreed between the parties. Delivery is deemed complete upon successful transmission or grant of access, regardless of whether the Client opens, downloads, reviews, or activates the Deliverable.
Techforest does not, as of the Effective Date, ship physical products. Should Techforest introduce physical products, merchandise, printed materials, or hardware in the future, the following principles shall apply unless superseded by a product-specific policy published at that time:
An Order is processed only after: (a) Techforest has issued a quotation, invoice, or order confirmation; and (b) the Client has made the required payment (in full or per the agreed advance/milestone structure) and provided any necessary briefs, content, or access. Techforest reserves the right to accept, decline, or modify any Order at its sole discretion prior to commencement of work, including where the requested scope is unclear, unlawful, or commercially unviable.
Estimated delivery timelines are communicated at the time of Order confirmation, typically in the form of a project timeline, sprint plan, or milestone schedule. All such timelines are good-faith estimates only and are NOT guaranteed delivery dates. Actual delivery may vary due to project complexity, scope changes, Client responsiveness, third-party dependencies, or other factors described in Section 18. Techforest shall bear no liability for any delay in delivery, irrespective of cause.
Timely delivery depends significantly on Client cooperation. The Client agrees to:
Any delay caused by the Client’s failure to fulfil these responsibilities shall extend delivery timelines proportionately, and Techforest shall have no liability for resulting delays.
Where a Service is structured around Milestones, each Milestone Deliverable will be shared with the Client for review upon completion. Delivery of a Milestone Deliverable is considered complete upon transmission, irrespective of whether the Client has reviewed it, subject to the acceptance process in Section 17.
Deliverables under this category may include design files, source code, deployed builds, staging links, or production deployment to Client-owned hosting/app stores. Delivery is deemed complete upon: (a) deployment to an agreed staging or live environment; or (b) transmission of source files/build packages to the Client. Submission to third-party app stores (e.g., Google Play, Apple App Store) is subject to those platforms’ independent review and approval processes, which are outside Techforest’s control; Techforest bears no liability for delays, rejections, or removals by such platforms.
Deliverables under this category are typically ongoing and reporting-based, including campaign setup, content calendars, ad creatives, and periodic performance reports, delivered electronically per the agreed reporting cadence (e.g., weekly/monthly). Delivery of a report or campaign asset is deemed complete upon transmission. As stated in Techforest’s Disclaimer, no specific ranking, traffic, lead, or conversion outcome is guaranteed as part of “delivery” under this Service category.
Deliverables include logo files, brand guidelines, design assets, and creative collateral, typically delivered in industry-standard formats (e.g., AI, PSD, PNG, PDF) via email or cloud link, within the agreed number of revision rounds. Delivery is deemed complete upon transmission of final approved files; source/editable files are provided only where expressly included in the Order.
Deliverables include final edited video files, written content, or other media, delivered electronically in agreed formats and resolutions within the agreed revision scope. Raw footage, project files, and unused takes are not part of standard delivery unless expressly agreed in writing and paid for separately.
Deliverables include affiliate program setup, tracking link configuration, partner onboarding documentation, and performance reports, delivered electronically per the agreed schedule. Commission payouts (where Techforest manages an affiliate program on a Client’s behalf) are subject to the specific affiliate program terms and are not governed by this Policy.
“Delivery” under the Technical Job Partner Program consists of facilitation activities such as candidate profiling, opportunity matching, introductions, and coordination communications, delivered via email, calls, or the Website portal. Delivery of these facilitation services is deemed complete upon provision of the relevant introduction, communication, or coordination output; it does not constitute or guarantee an employment offer, placement, or income outcome, as further described in Techforest’s Disclaimer.
Deliverables include access credentials to course content, learning materials, live or recorded sessions, and (where applicable) a certificate of participation or completion. Delivery is deemed complete upon grant of access to the relevant learning platform/materials. Certificates, where issued, are delivered electronically upon satisfaction of the applicable completion criteria and do not, by themselves, guarantee external recognition, as set out in the Disclaimer.
Upon receipt of a Deliverable, the Client is required to review it and provide written approval or specific, written feedback within the timeframe communicated by Techforest (or, if none is specified, within seven (7) calendar days). If the Client does not respond within the applicable period, the Deliverable shall be deemed accepted and delivery shall be deemed complete and final for all purposes, including payment and non-refund obligations.
Techforest shall not be responsible for delays caused by: (a) incomplete, delayed, or inaccurate information, content, or approvals from the Client; (b) Client failure to make timely payments; (c) issues with Client-owned hosting, domains, or third-party accounts; (d) delays caused by third-party platforms, vendors, or service providers; or (e) any Force Majeure event described in Section 20. Any such delay shall extend project timelines accordingly without any liability, penalty, or compensation owed by Techforest.
Certain Deliverables may depend on third-party platforms, tools, hosting providers, payment gateways, courier/logistics partners (for any future physical products), app stores, or marketing platforms. Techforest is not responsible for delays, errors, outages, policy changes, or failures attributable to such third parties, and any resulting impact on delivery timelines is excluded from Techforest’s liability.
Techforest shall not be liable for any failure or delay in delivery resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, civil unrest, strikes, government action or regulation, internet or power outages, cyberattacks, or failures of third-party infrastructure or logistics providers. Performance obligations shall be suspended for the duration of such event, and Techforest shall have no liability for resulting delays.
Where a Deliverable fails to reach the Client due to an incorrect email address, inactive account, blocked domain, full mailbox, lapsed access credentials, or any other Client-side issue, Techforest will make reasonable efforts to re-send the Deliverable upon notification but shall bear no liability for any loss, delay, or inconvenience caused by such failed delivery. Re-delivery does not entitle the Client to any refund, discount, or compensation.
For digital Deliverables, risk of loss, corruption, or non-receipt of a file transmitted electronically passes to the Client upon successful transmission by Techforest (e.g., upon the email being sent or the access link being shared), regardless of whether the Client successfully downloads or opens it. For any future physical products under Section 5, risk shall pass to the Client upon handover of the goods to the courier/logistics partner. Ownership of Deliverables transfers to the Client only upon full and final payment of all Fees due, in accordance with Techforest’s Website Terms & Conditions.
ZERO-REFUND POLICY: All Fees, shipping charges, and taxes paid to Techforest for any Service, Deliverable, or (where applicable in future) physical product are FINAL and NON-REFUNDABLE under all circumstances, except where mandatorily required by applicable law. |
Where applicable, delivery-related charges (e.g., expedited processing, hosting setup, or future physical shipping/handling fees) will be communicated to the Client prior to confirmation of the Order and are payable in addition to Service Fees. All charges are exclusive of applicable taxes (including GST) unless stated otherwise. No refund of shipping charges, handling fees, or taxes shall be made once a Deliverable has been transmitted, made accessible, or dispatched, regardless of subsequent Client dissatisfaction, non-use, or change of mind.
The Client must inspect each Deliverable promptly upon receipt and report any defect, non-conformance, or issue in writing within seven (7) calendar days of delivery (or such other period as may be specified for a particular Service). Failure to report an issue within this period shall constitute final acceptance of the Deliverable, as set out in Section 17. Techforest will review timely-reported issues in good faith and may, at its sole discretion, provide a correction, revision, or remediation; this does not entitle the Client to a refund.
Techforest reserves the right to suspend or withhold delivery of any Deliverable, in whole or in part, at its sole discretion, where: (a) payment is overdue or incomplete; (b) the Client has breached the Terms & Conditions or this Policy; (c) requested content/approvals remain outstanding; or (d) Techforest reasonably suspects fraud, unlawful use, or misuse of its Services. Suspension under this Section does not entitle the Client to any refund of amounts already paid.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TECHFOREST SHALL HAVE ZERO LIABILITY for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profit, revenue, business opportunity, data, or goodwill, arising out of or in connection with any delay, non-delivery, partial delivery, failed delivery, or defect in a Deliverable, regardless of the legal theory asserted (contract, tort, negligence, strict liability, or otherwise), and even where Techforest has been advised of the possibility of such damages. Where liability cannot be lawfully excluded in full, Techforest’s aggregate liability arising from any delivery-related claim shall not exceed the lesser of (a) the Fees actually paid by the Client for the specific Deliverable giving rise to the claim, or (b) INR 5,000, consistent with the limitation of liability provisions in Techforest’s Website Terms & Conditions.
Techforest’s delivery practices are intended to comply with applicable Indian law, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (in respect of any personal data transmitted as part of delivery), and, in respect of any future physical products, applicable consumer protection and e-commerce regulations, including the Consumer Protection (E-Commerce) Rules, 2020, to the extent mandatorily applicable. Nothing in this Policy excludes liability that cannot be lawfully excluded under such mandatory provisions.
Techforest reserves the right to modify, update, or replace this Policy at any time, at its sole discretion. Changes take effect immediately upon publication on the Website with a revised “Last Updated” date. Continued use of Techforest’s Services after such changes constitutes acceptance of the revised Policy. Clients are encouraged to review this Policy periodically.
This Policy is governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with this Policy shall first be addressed through good-faith negotiation and, if unresolved, shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat and venue of arbitration in India, consistent with the dispute resolution provisions of Techforest’s Website Terms & Conditions.
